Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Emrius mobile application (the "App") operated by Emrius ("we," "our," or "us").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Emrius is a fitness and wellness application that provides:

  • Workout plans and exercise tracking
  • Diet plans and nutrition logging
  • Progress tracking and analytics
  • Social features for connecting with other users
  • Premium subscription features

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. User Content

You retain ownership of content you create in the App (workouts, photos, posts). By posting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute your content within the App.

You agree not to post content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights
  • Contains harmful, offensive, or inappropriate material
  • Impersonates others or is misleading

5. Subscriptions and Payments

Premium Subscription

The App offers premium subscription plans with additional features. Subscriptions are managed through the Apple App Store or Google Play Store.

  • Subscription prices are displayed in the App
  • Payment is charged to your app store account
  • Subscriptions auto-renew unless cancelled 24 hours before the end of the current period
  • Manage or cancel subscriptions through your device's app store settings

Refunds

Refund requests are handled by Apple or Google according to their respective policies. We cannot directly process refunds for app store purchases.

6. Advertising

For Non-Premium Users

The App displays advertisements to users who do not have an active premium subscription. These advertisements are served by Google AdMob.

By using the App, you acknowledge and agree that:

  • Advertisements may be displayed during your use of the App
  • AdMob may collect information about your device and ad interactions as described in our Privacy Policy
  • Ad content is provided by third-party advertisers and we are not responsible for the content of these ads
  • You may upgrade to a premium subscription to remove advertisements

Ad Interaction

You understand that:

  • Clicking on advertisements may direct you to third-party websites or apps
  • We are not responsible for the content, products, or services offered by advertisers
  • Any transactions with advertisers are solely between you and the advertiser

7. Health Disclaimer

The App provides general fitness and nutrition information for educational purposes only. This information is not medical advice.

  • Consult a healthcare professional before starting any exercise or diet program
  • The App is not a substitute for professional medical advice, diagnosis, or treatment
  • You are solely responsible for your health decisions
  • We are not liable for any injuries or health issues resulting from use of the App

8. Intellectual Property

The App and its original content, features, and functionality are owned by Emrius and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or decompile the App
  • Use the App for any commercial purpose without permission
  • Remove any copyright or proprietary notices

9. Prohibited Uses

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Upload viruses or malicious code
  • Collect information about other users without consent
  • Use automated systems to access the App

10. Termination

We may terminate or suspend your account and access to the App:

  • For violations of these Terms
  • For any conduct we deem harmful to other users or the App
  • At our sole discretion, with or without notice

Upon termination, your right to use the App ceases immediately.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • Results from using the App will be accurate or reliable

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profits or data
  • Personal injury or property damage
  • Any damages arising from your use of the App

Our total liability shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Emrius and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another

14. Third-Party Services

The App integrates with third-party services including:

  • Firebase (Google)
  • Google AdMob
  • RevenueCat
  • Apple/Google authentication

Your use of these services is subject to their respective terms and privacy policies.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Emrius operates, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

  1. Good faith negotiation
  2. Mediation
  3. Binding arbitration (if required by applicable law)

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting in the App. Your continued use of the App after changes constitutes acceptance of the new Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emrius regarding the App.
